The 'bad actor' clause in the CA bills has nothing to do with the DoJ's position, nor does it have to. The state has the right to legislate gaming as it sees fit. There is nothing preventing CA from preventing Pokerstars from entering their market. There is no expiration date. You may be referring to NV's bad actors clause, which was a five year ban. That is not the case in the CA legislation, there is no five year limit. Again, you should read the CA bills. I'll link them at the bottom of this comment. But the gist of it is that any entity that accepted bets from US players after 12.31.2006 is barred. Not only are the companies barred, but so is their intellectual property. That means no other company can use Pokerstars' software to get around the bad actors clause. I would have liked to see Pokerstars fight as well, but they probably would have lost anyway, and the result would have been much worse than the settlement. That is why people/companies decide to settle. For the DoJ's part, they got everything they needed to out of Pokerstars in the settlement . . . blocked them from the US market and sucked them for $750m. That's a win/win without risk. Can't say they played it wrong at all. The other cardrooms are not going to be pleased with the Goliath that this coalition will be. The players will flock there and not to other operators. That lack of players will doom those operations. Plus, not only will those operators not be able to reap the revenue from online poker, but they will be further set back by the marketing advantage Goliath gains from offering online games. No, things got stickier, not better. At least as far as getting something done. Now mind you, after all I've said, I think the Pokerstars/Morongo/Commerce/Bike coalition is awesome for players. I'll be thinking of moving to CA if it actually happens, and no doubt that is the only place I will play online. But it's a road block to getting something done, that can't really be denied.
